General terms and conditions

The following rules govern the use of the Knowledge Sharing and Exchange Platform of the Regional Small Business Program in Central Asia (hereinafter – “the Platform"). Having registered on the Platform, registered users agree with the Terms of Use of the system version that was in effect at the time of their registration. The Terms of Use are accessible on the Platform website at all times (www.rsbp-ca.org).

The Platform is maintained and the services on its basis are provided by the Regional Small Business Program in Central Asia (hereinafter – “the Provider”). The Regional Small Business Programme is a project of IPC Internationale Projekt Consult GmbH. Contact details are provided at the respective page here.

The Provider reserves the right to make amendments to these Terms of Use at any time. The user will be notified of any changes in the Terms of Use through a notification in the "News" section of the Platform not later than within four weeks before the changes come into force. The Provider is entitled to modify or cancel the terms of use of the services at any time, or replace them with other services provided on the same or other conditions.

Registration access data

For access to the e-learning Platform or to some of its parts, the Provider may require registration of users. The Provider establishes restrictions on user registration, including access to registration on the Platform for a particular user. The Provider saves the user login, password, and email address in the system. The provision of these data is a prerequisite for registration.  The Provider has the right to cancel registration of any user.

The user entitles the Provider with the right to store and use his personal data to the extent necessary to ensure the objectives of the Program. The Provider undertakes not to disclose this information to third parties, except as may be necessary for the implementation of the Programme and the training process. The user agrees that his first and last names will be available to other users of the Platform on the forums and in case he publishes any documents on the Platform.

The personal data storage, processing and disclosure to third parties is governed by the personal data policy. The personal data policy is available on the Platform.

To register on the Platform, the user creates a login and a password ("access data"). All users are responsible for keeping their access data confidential and for taking measures to prevent their misuse. Disclosure of access data to third parties is regarded as a case of access data misuse. If a user becomes aware of his access data misuse, he must immediately inform the Provider about it and change his Platform access password. If there is a fact of access data misuse, the Provider has the right to block the user's access data immediately.

Scope of services

Access to the Platform is provided via the Internet. The Provider grants the user the right to post information and his/her materials on the Platform subject to compliance with these Terms of Use. In addition, the Provider ensures the user should have access to various discussion forums and other functions of the Platform to the extent possible and consistent with the objectives of the Platform. The Provider does everything possible to maintain the functionality of these functions. The Provider does not assume any additional obligations. In particular, the user does not have the right to demand that the service are available at all times and provided in an unchanged form.

At any time, the Provider can make changes to the Platform or terminate the provision of the Platform services.

Right of use

Access to the Platform is provided through public Internet channels. At the same time, some parts of the platform are available only to registered users, or to a certain group of registered users. The Provider has the right to freely determine what information or service will be available to the general public, and also to change the availability of information or services at its own discretion without the prior notification of users. Information presented on the Platform cannot in any form be transferred to third parties, published or made available to the general public, unless this is explicitly permitted. Dissemination of the Platform contents is prohibited.

All materials published on the Platform, including images, the programme code, logos, graphics, sounds are subject to copyright or related rights and protected in accordance with the intellectual property laws of the Republics of Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, and Uzbekistan.

When using the Platform, it is prohibited to download, exchange between users, change or post any information, data or images in violation of the exclusive rights of third parties, including copyrights and related rights, as well as exclusive rights to an invention, a utility model, an industrial prototype or a trademark.

The user shall be liable for any violation of third-party rights to results of intellectual activity and means of individualization, in particular, copyrights and related rights, as well as exclusive rights to an invention, a utility model, an industrial prototype or a trademark.

In the Platform sections, the user has the right to publish only those comments (including the profile image, the text of the comment and photos attached) that do not violate the current legislation and/or third-party rights. In the event that such work is subject to copyright or includes it, the user warrants that he is entitled to such use. By publishing such objects, the user entitles the Provider with the right to use them, without territorial or time restrictions, by way of reproducing, disseminating, translating, publicly performing, publicly displaying, broadcasting by wire and cable, making it publicly available.

The Provider reserves the right to block any information published by the user that violates third-party intellectual and/or exclusive rights, including copyright and related rights – either on demand of the owner or without it.

The content of the website can be copied and downloaded exclusively for personal use in the framework of the learning process, unless agreed otherwise by special terms of use.

User obligations

The user guarantees to the Provider that he will not publish any materials on the Platform violating the norms of morality and the current legislation. In particular, the user undertakes not to publish the following materials:

  • Publications instigating racial, national hatred or hatred to a particular social group;
  • Materials violating the copyrights, trademarks, competition laws;
  • Malicious files and data, including data that can affect the functioning of the Platform;
  • Publications containing aggressive, racial, discriminatory or pornographic materials;
  • Promotional/advertising materials.

The Provider has the right to block access to any information or materials posted by the user. Any damage caused to the Provider as a result of such a violation must be compensated by the user in accordance with applicable laws.

The user releases the Provider from any third party claims that may arise as a result of the user's violation of their rights. The user undertakes to support the Provider in settling such claims. In addition, the user is obliged to reimburse the Provider for the legal fees payable for the respective legal protection.

Since no pre-moderation of materials published by users on the Platform is implemented, violations may not be identified and rectified immediately as they occur. In this regard, the Provider waives any liability for the content of the materials posted by users on the Platform. Each user is personally responsible for their actions in accordance with applicable laws.

The user bears full responsibility for his personal data, which he posts on the website. The user guarantees that the said personal information is true and belongs personally to him. The user undertakes to keep the personal data of other users confidential as it becomes available to him and not to use it for commercial purposes. Such data include, in particular, names, postal, e-mail, and Internet addresses.

User agreement to receive information

The user agrees to receive informational and technical messages sent by the platform administration to the email address the user indicated during registration as well as in the “User Profile” section.

The user agrees to receive informational messages on a regular basis and is aware of the possibility to refuse to receive informational messages in the manner described in the text of each informational message. Copyrights

The user who posted his materials on the website retains the copyright to the relevant materials. However, by placing its materials on the Platform, the user grants the Provider the right to make this placement permanently available. The provider has the right to change the location of materials within the Platform and create links to them from the content of other pages of the Platform.

Termination of the right of use to the Platform

The user can terminate its right of use of the Platform at any time by sending a notification to the Provider; there is no deadline for advance notice. Upon receiving the notification, the Provider blocks the user's access to the Platform. In turn, the Provider has the right to terminate the user's right to use the Platform without prior notice if there are compelling reasons (for example, the user violates these Terms of Use).

Claims and liability

The content of the Platform has been constructed with utmost care and attention. Nevertheless, the Provider does not warrant the accuracy, completion and up-to-datedness of the entire content. The user shall bear all risks arising from the use of the website content. Placements made by individual users under their respective names reflect the views of these authors which do not necessarily reflect the views of the Provider.

The Provider shall not be liable for any damages incurred as a result of disconnections of electricity supplies, the servers and other facilities that are not in the sphere of its competence.
